1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Purchaser," or "Architect") and Viblysunnyptch Design Systems LLC ("Viblysunnyptch," "we," "us"). By accessing or utilizing our website at viblysunnyptch.com, interacting with our digital 3D WebGL simulators, or placing a commercial order for FoldForm products, you agree to be bound unconditionally by these Terms.
2. Intellectual Property & Patent Protection
All design assets, trade secrets, patented kinematic hinge geometries, industrial design drawings, 3D polygon meshes, text copy, editorial essays, and graphical marks exhibited on this site are the exclusive intellectual property of Viblysunnyptch Design Systems LLC.
- Kinematic Joint Patents: The dual-fulcrum bi-axial hinge assembly utilized in FoldForm Chair MK.IV and Monolith Trestle Table is protected under United States and international utility patent filings. Unauthorized reverse-engineering, CNC reproduction, or mechanical imitation is strictly prohibited and subject to injunctive relief and statutory damages.
- Digital Content Copyright: All photographs, 3D WebGL code, and dimensional drawings are protected under the United States Copyright Act of 1976 and the Berne Convention.
3. Structural Integrity, Intended Use & Safety
FoldForm furniture systems are engineered and stress-tested to stringent international standards (including ANSI/BIFMA and EN 12520). However, the purchaser acknowledges that transforming kinetic furniture incorporates mechanical shear points and articulating linkages.
- Pinch Point Caution: Users must follow the sequential deployment guides provided with every unit. Keep fingers clear of hinge cavities during folding operations.
- Rated Load Parameters: The FoldForm Chair MK.IV is rated for a maximum dynamic distributed load of 340 kg (750 lbs). The Monolith Trestle Table is rated for a maximum surface load of 220 kg (485 lbs). Exceeding these engineering tolerances immediately voids structural warranties.
- Alterations: Any unauthorized drilling, welding, hinge disassembly, or replacement of factory fasteners with non-OEM components will terminate all structural liabilities held by Viblysunnyptch.
4. 10-Year Limited Structural Warranty
We provide a comprehensive Ten (10) Year Limited Manufacturer's Structural Warranty on all FoldForm furniture frames, milled 7075 aluminum hinges, and carbon retention brackets. This warranty covers:
- Structural metal fatigue failure or weld fracture under normal interior residential or commercial office use.
- Failure of internal IGUS® polymer bearings causing mechanical joint seizure.
- Delamination of solid kiln-dried ash wooden boards resulting from factory adhesive failure.
Exclusions: The warranty does not cover normal aesthetic patination of natural hardwoods, cosmetic scratches on anodized finishes resulting from abrasive impacts, or damage sustained from prolonged submersion in water or outdoor weathering.
5. Commission Orders, Cancellations & Returns
Standard production orders may be cancelled within forty-eight (48) hours of submission with zero penalty. Custom architectural commissions involving bespoke wood stains or non-standard anodized hues enter CNC cutting immediately and are non-refundable once material billet machining begins. For standard products, returns are accepted within thirty (30) days of delivery in original crating; purchaser is responsible for insured return freight charges.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE JURISDICTION, VIBLYSUNNYPTCH DESIGN SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, SPATIAL DISRUPTION, OR COMMERCIAL INTERRUPTIONS, ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR PRODUCTS OR DIGITAL SIMULATORS. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE TOTAL PURCHASE PRICE PAID BY PURCHASER FOR THE SPECIFIC UNIT GIVING RISE TO THE CLAIM.
7. Governing Law & Dispute Resolution
These Terms and any disputes arising directly or indirectly hereunder shall be governed by and construed under the laws of the State of Texas, United States, without regard to conflicts of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the state or federal courts located in Travis County, Austin, Texas, USA.
